Terms of service
Terms of Service and Trade
Effective date: 2 August 2026
These Terms apply to the use of the Titan Bolt Kits website and to all quotations, orders, goods and services supplied by Titan Bolt Kits.
By creating an account, requesting a quotation, placing an order, accepting a quotation or accepting delivery, you confirm that you have read and agreed to these Terms.
1. Business customers
Titan Bolt Kits primarily supplies customers purchasing goods for trade, commercial and industrial purposes.
You confirm that you are authorised to place orders on behalf of the customer or organisation shown on the account.
Where goods or services are supplied and acquired in trade, both parties are in trade, and it is fair and reasonable, the parties agree in writing that the Consumer Guarantees Act 1993 does not apply.
Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded.
2. Customer accounts
You are responsible for:
- keeping your account details accurate;
- protecting access to your account;
- ensuring authorised users use the correct company account;
- reviewing delivery, contact and purchasing information; and
- notifying Titan Bolt Kits promptly of unauthorised account use.
The customer is responsible for orders placed through its approved company account by its staff, representatives or authorised users.
Titan Bolt Kits may suspend or restrict an account where reasonably required for security, overdue payment, suspected misuse or breach of these Terms.
3. Product information and selection
Product descriptions, images, dimensions, compatibility information and technical content are provided to assist product selection.
Before ordering or installation, the customer must confirm that the selected:
- DN size;
- flange standard;
- pressure class;
- connection type;
- bolt diameter and length;
- gasket material;
- valve or component type;
- quantity; and
- material specification
are suitable for the intended application.
Any recommendation is based on the information supplied to Titan Bolt Kits. The customer remains responsible for providing complete and accurate application information.
Products must be installed and used by suitably competent persons in accordance with applicable engineering requirements, manufacturer instructions and industry practice.
Website information is not a substitute for project-specific engineering advice.
4. Prices and GST
Unless stated otherwise, prices displayed on the website are in New Zealand dollars and include New Zealand GST.
Freight, rural charges, redelivery charges, special handling and other applicable costs are additional unless expressly included.
Prices may differ according to the customer’s approved account pricing or discount level.
Titan Bolt Kits may correct an obvious pricing, description, calculation or data-entry error before accepting or dispatching an order. We will contact the customer where a correction materially affects the order.
5. Quotations and quote requests
Submitting a quote request does not create an order or require Titan Bolt Kits to supply the requested goods.
A quotation becomes available once it has been reviewed, priced and marked as sent by Titan Bolt Kits.
Unless stated otherwise:
- pricing is valid until the expiry date shown;
- availability is subject to confirmation;
- freight may be estimated or confirmed separately; and
- acceptance after the expiry date requires confirmation from Titan Bolt Kits.
A quotation is not an order until the customer instructs Titan Bolt Kits to proceed and Titan Bolt Kits accepts that instruction.
6. Orders and acceptance
All orders are subject to acceptance by Titan Bolt Kits.
We may reasonably decline, place on hold or cancel an order before dispatch where:
- stock or supplier availability has changed;
- pricing or product information contains an error;
- payment requirements have not been met;
- the customer has exceeded its credit limit;
- the customer’s account is overdue;
- information required to fulfil the order is missing; or
- supply is not reasonably possible.
Where payment has already been received for a cancelled item, the applicable amount will be refunded or credited.
Changes requested after an order is accepted may affect price, availability and dispatch time.
7. Purchase orders
Where a purchase order number is required by the customer’s account, the customer is responsible for supplying the correct number.
Failure to provide an internal purchase order does not invalidate an order that was placed by an authorised user of the customer’s account.
8. Payment
Card-payment orders must be paid in accordance with the checkout requirements.
For approved Trade Credit Accounts, unless otherwise agreed in writing, payment is due on the 20th of the month following the invoice date.
Titan Bolt Kits may:
- establish or vary a credit limit;
- require payment before dispatch;
- place overdue accounts on hold;
- suspend or withdraw credit facilities; and
- allocate payments against outstanding amounts.
Opening a Trade Credit Account does not guarantee continued credit approval.
9. Overdue accounts
Interest may be charged on overdue amounts at 2% per month, calculated from the due date until payment.
The customer must reimburse Titan Bolt Kits for reasonable costs incurred in recovering an overdue debt, including collection agency, tracing and legal costs where recoverable.
10. Freight and delivery
Delivery is governed by the Titan Bolt Kits Shipping Policy, which forms part of these Terms.
Dispatch and delivery dates are estimates only unless Titan Bolt Kits expressly agrees otherwise in writing.
Titan Bolt Kits is not responsible for delay caused by courier disruption, supplier delay, weather, industrial action, government action, system failure or another event outside our reasonable control.
The customer must provide an accurate delivery address and suitable delivery instructions.
11. Inspection and claims
The customer must inspect goods promptly after delivery.
Shortages, incorrect goods, visible damage and suspected freight damage should be reported within five working days, together with the order number, photographs and reasonable supporting information.
This reporting period does not remove any statutory right that cannot lawfully be excluded.
12. Returns and refunds
Returns and refunds are governed by the Titan Bolt Kits Return and Refund Policy, which forms part of these Terms.
Returns require prior approval.
Special-order, non-stock, custom, cut, altered, assembled or specifically procured goods are normally non-returnable unless faulty, incorrectly supplied or otherwise required by law.
Approved non-faulty returns may be subject to return freight and a reasonable restocking or supplier-return fee advised before approval.
13. Warranty
Where available, Titan Bolt Kits will pass on the benefit of an applicable manufacturer warranty.
Warranty claims may require photographs, application details, proof of installation, return of the goods or inspection.
A warranty does not cover a problem caused by:
- incorrect product selection;
- unsuitable application;
- incorrect installation;
- misuse or modification;
- chemical or environmental incompatibility;
- excessive loading;
- failure to follow manufacturer requirements; or
- normal wear and tear.
Nothing in this clause limits rights that cannot lawfully be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Titan Bolt Kits’ liability relating to affected goods or services is limited, at our option, to:
- repair;
- replacement;
- resupply;
- credit; or
- refund of the amount paid for the affected goods or services.
To the maximum extent permitted by law, Titan Bolt Kits is not liable for indirect or consequential loss, loss of profit, loss of production, loss of contracts, business interruption or loss arising from delay.
Where liability cannot be excluded, Titan Bolt Kits’ total liability is limited to the amount paid for the goods or services giving rise to the claim, except where a different remedy is required by law.
15. Retention of title
Ownership of goods supplied on credit remains with Titan Bolt Kits until all amounts owing for those goods have been paid in full.
Risk of loss or damage passes in accordance with the Shipping Policy and is separate from ownership.
Until ownership passes, the customer must keep unpaid goods reasonably identifiable and must not knowingly grant an inconsistent security interest over them.
16. Personal Property Securities Act
The customer acknowledges that these Terms may create a security interest in goods supplied on credit and in the proceeds of those goods under the Personal Property Securities Act 1999.
The customer agrees to provide information and reasonably assist Titan Bolt Kits where required to register, maintain, protect or enforce that security interest.
17. Privacy and credit information
Personal and commercial information is handled in accordance with the Titan Bolt Kits Privacy Policy.
An applicant for credit authorises Titan Bolt Kits to:
- contact supplied trade references;
- verify application information;
- undertake lawful commercial credit enquiries; and
- disclose relevant information to credit-reporting, collection, legal or professional service providers where reasonably required.
18. Website use
You must not:
- misuse or interfere with the website;
- attempt unauthorised access;
- submit false account or ordering information;
- copy substantial website content for commercial use without permission; or
- use the website unlawfully.
Product images, written content, branding, software and website materials remain the property of Titan Bolt Kits or the relevant rights holder.
19. Availability of the website
We do not guarantee that the website, customer portal, quote system or account features will always be uninterrupted or error-free.
Where an online feature is unavailable, customers may contact Titan Bolt Kits directly to request assistance.
20. Force majeure
Titan Bolt Kits is not liable for delay or failure caused by circumstances outside its reasonable control, including:
- supplier failure;
- transport or courier disruption;
- natural disaster;
- fire or flood;
- industrial action;
- government action;
- epidemic;
- utility interruption; or
- technology or network outage.
We will take reasonable steps to minimise the effect of the disruption.
21. Changes to these Terms
Titan Bolt Kits may update these Terms from time to time.
Updated Terms apply to quotations requested and orders placed after the updated version is made available. Changes do not retrospectively alter an order already accepted unless agreed by both parties or required by law.
22. Severability
If any provision is unlawful or unenforceable, that provision will be read down or removed to the minimum extent necessary. The remaining provisions continue to apply.
23. No waiver
A failure or delay by either party to enforce a right does not waive that right.
24. Governing law
These Terms are governed by the laws of New Zealand.
The parties submit to the jurisdiction of the New Zealand courts.
